Pennsylvania roofer cited for repeated fall hazards, added to severe violator list

A Pennsylvania roofing contractor has been placed in the U.S. Department of Labor’s Severe Violators Enforcement Program and faces $467,000 in proposed fines after federal inspectors found workers exposed to fall and safety hazards at a job site in Lackawanna County.

The Occupational Safety and Health Administration (OSHA) cited Luis Alberto-Reyna Avila, owner of 3 Guys Home Improvement Inc., for two willful and 10 serious violations following a September 2024 inspection prompted by an imminent danger complaint.

Fall risks, electrical hazards, and ladder misuse cited

OSHA said the company failed to provide required fall protection and did not ensure workers used personal protective equipment. Inspectors also found unsafe practices involving flammable materials, work near energized power circuits, and improper ladder use.

The agency described the violations as part of a pattern. “This employer has repeatedly failed to take even basic steps to protect workers on the job,” said OSHA officials. “Adding the company to the Severe Violator list reflects the seriousness and recurring nature of these hazards.”

History of violations prompts stricter oversight

Due to its track record, 3 Guys Home Improvement Inc. has been added to OSHA’s Severe Violators Enforcement Program, which targets employers that demonstrate indifference to legal obligations to provide safe working conditions.

The company has 15 business days from receiving the citations to comply, request an informal conference with OSHA’s area director, or contest the findings before the Occupational Safety and Health Review Commission.
