A union steamfitter who suffered a debilitating spinal injury after falling from a ladder while working on an HVAC installation at a New York hospital has secured a $4 million settlement.
The compensation was obtained by attorney Michael Zisser of Wingate, Russotti, Shapiro, Moses & Halperin, LLP, despite a series of liability challenges raised by the defense. The 56-year-old worker, who required cervical fusion surgery, was unable to return to his job following the incident.
Zisser said the case involved significant legal hurdles, including arguments from the defense that the worker was solely responsible for the fall and that his delayed medical treatment weakened claims about the severity of his injury.
Overcoming legal obstacles
To counter these claims, Zisser relied on detailed preparation, deposition testimony, and legal arguments that led to summary judgment on a key Labour Law 240(1) claim.
“This case was particularly complex, but with hard work and a commitment to my client, we were able to reach a settlement that will make a significant difference in his life,” Zisser said. “It’s a testament to the importance of fighting for injured workers.”
